Terms and Conditions – Burnett Today 2021 Our Town Competition
Readers / Shoppers

General

  1. The Promoter is The South Burnett Today Pty Ltd (‘the promoter’) of 154 Haly Street, Kingaroy Queensland 4601. ABN 64 641 796 349. Telephone number: 07 41820450.
  2. Information on how to enter and prizes forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
  3. If there is any inconsistency between these Terms and Conditions and anything else that refers to this competition, these Terms and Conditions will prevail.

Who can enter

  1. Entry is open to permanent residents of Queensland who reside in the South Burnett Times distribution area over the age of 18 years; except employees and immediate families of the Promoter, Sponsors and their associated companies and agencies.
  2. Immediate family includes the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or first cousin.
  3. Entrants must be 18 years of age or older as at the date of entry in order to be eligible to enter the competition.
  4. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity or proof of registration ownership in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

When to enter

  1. The competition commences on Thursday October 14, 2021 and concludes on Saturday November 13, 2021 at 5:00pm AEST. Entries must be received by the Promoter prior to the competition close date and time.
  2. The time of entry will in each case be the time the entry form is received by the Promoter, not at the time of submission by the entrant.
  3. The Promoter accepts no responsibility for any late, lost or misdirected entries including SMS messages not received by the Promoter or delays in the delivery due to technical disruptions, network congestion or for any other reason.

How to enter

  1. The details of how to enter the competition are set out in the Burnett Today Newspaper, cover dates between Thursday October 14, 2021 and concludes on Saturday November 13, 2021.
  2. Entrants may enter the competition by:
    • Making a purchase of $15.00 or more in a single transaction of products priced at the prevailing market value of that product, from any participating Our Town business, to receive an original entry form for completion.
    • Individual receipts from one (1) retailer that total $15.00 from multiple transactions are not accepted.
    • Entrants must complete the entry form in full with all fields filled in correctly, and place the completed entry in either the entry box supplied at the participating store or your nearest Visitors Information Centre near you. Entries can also be posted and addressed to “Our Town Competition” post the entry to:
    o Postal: 154 Haly Street, Kingaroy Qld 4610; or
    o Deliver: 154 Haly Street, Kingaroy Qld 4610.
  3. Participating Businesses will be listed in the Burnett Today throughout the promotion.
  4. Not all Our Town Participants will have entry forms for the competition. Entrants should refer to the listings provided in the Burnett Today (refer Clause 13).
  5. Receipts from Lay-by, bill payments, such as credit card bills, gift card purchases, bank transactions, bank fees, charges and service bills such as gas, electricity, rates and water, phone, plumbing services, building, medical bills etc. are not deemed as products for purchase for the purposes of this competition.
  6. Entrants are required to take full responsibility for the content of their entry and for ensuring that their entry complies with these terms and conditions. For the purposes of these content requirements, “entry content” includes any content (including text, photos, videos and email messages) that entrants submit, upload, transmit, publish, communicate or use in connection with their entry into the Promotion.
  7. Entries must be the entrant’s original work. The Promoter reserves the right to verify, or to require the entrant to verify, that the entry is the entrant’s original work. If an entry cannot be verified to the Promoter’s satisfaction, the entry will be deemed invalid. The Promoter may, in its absolute discretion, edit, modify, delete, remove or take-down any part of an entrant’s entry.
  8. An entrant’s entry must not include:
    (a) any image or voice of any other person without that person’s express consent. Entrants warrant that if any such content is included, they have obtained the express consent of the relevant person;
    (b) any content that contravenes any law, infringes the rights of any person or is potentially insulting, inflammatory, defamatory, obscene, offensive, discriminatory, indecent or otherwise objectionable or inappropriate (which includes, without limitation, any content involving nudity, malice, excessive violence or swearing); and
    (c) any literary, dramatic, musical or artistic work, any audio-visual or sound recording, or any other item in which copyright subsists, unless the entrant is entitled to do so. If an entrant has any doubts about whether they have the right to include any content (for example, recorded music) they must not include it. By including any such content in their entry, the entrant warrants that they have the permission of the relevant copyright owner to do so and that this permission allows the Promoter to use the entry in accordance with these terms and conditions.
    (d) The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
  9. Any entry that is made on behalf of an entrant by a third party will be invalid, unless the entrant requires the assistance of a third party to enter due to a disability.
  10. The Promoter reserves the right to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these terms and conditions or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses, PO Box addresses or SIM cards to register single or multiple purchases.

Number of Entries permitted

  1. Entrants may enter as many times as they like; However, only one (1) major prize will be awarded $5000.00 only one (1) second (2nd) prize awarded $1000.00 and only one (1) third (3rd) prize $500.00 awarded.
  2. Each entry form must be original, and the entrant must write their receipt number and or have the entry stamped by the participating business of purchase with that participating business matching the entry form.

Draw and Notification of winner.

  1. The winners will be the first three (3) valid entries submitted in accordance with these terms and conditions, that is drawn by the major sponsor Ken Mills Auto at 154 Haly Street, Kingaroy Qld 4610 by random draw on Monday November 22, 2021 at 10:00am AEST.
  2. If any particular draw is scheduled on a public holiday, the draw will be conducted on the following business day.
  3. The Promoter’s decision is final and the Promoter will not enter in to correspondence regarding the competition result or any other decisions the Promoter makes in connection with the Promotion.
  4. The winner’s will be notified by telephone immediately within two days of the draw.
  5. The winner’s details will be published in the Burnett Today and online at www. burnetttoday.com.au on or by Thursday November 25, 2021.
  6. The winner’s must present to the Burnett Today office within 48 hours of the draw to claim their prize. If the winner does not claim their prize within 48 hours, another entry will be chosen via random draw immediately and a new winner contacted by telephone immediately after that draw.
  7. Prizes will be awarded to the person named in the entry. Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

Prize on offer

  1. Three individual prize values are, major prize is $5,000 (five thousand dollars) cash, second prize is $1,000 (one thousand dollars) cash and third prize is $500 (five hundred dollars) cash.
  2. Total prize pool value is $6,500.00 (six thousand five hunded dollars).
  3. Major prize winner will receive $5,000 (five thousand dollars) cash, paid by Electronic Funds Transfer (eft) into a bank account in the winner’s name. Second prize winner will receive $1,000 (one thousand dollars) cash, paid by Electronic Funds Transfer (eft) into a bank account in the winner’s name. Third prize winner will receive $500 (five hundred dollars) cash, paid by Electronic Funds Transfer (eft) into a bank account in the winner’s name
  4. A bank statement must be produced with the winner’s details to verify the bank details for transfer.
  5. The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
  6. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
  7. Prizes cannot be transferred, exchanged or redeemed for cash.
  8. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements. It is the responsibility of the winner’s to confirm such conditions with the prize supplier or other relevant third parties.
  9. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
  10. All entrants agree that if they win the prize, they will not, and their companions will not, sell or otherwise provide their story and/or photographs to any media or other organisation, including the internet. Photographs will be allowed only at the discretion of the Promoter.
  11. In order to receive any cash prizes the name provided by the entrant in his or her entry must be the same as the name of an eligible bank account into which an electronic funds transfer may be deposited. If a winning entry does not contain this information, then the Promoter may not be able to distribute the prize to the winner.
    Further Terms and Conditions
  12. Subject to complying with all relevant State and Territory legislation, the Promoter reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of the competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition.
  13. The Promoter and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
  14. If for any reason this competition is not capable of running as planned, including (without limitation) due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, the Promoter reserves the right in its sole discretion to take any action that may be available, and (without limitation) to cancel, terminate, modify or suspend the competition, subject to any direction given under State Regulation.
  15. Entrants are responsible for any cost associated with accessing the promotional website. Access to that site is dependent on the Internet service provider.
  16. All entries must be sent or delivered to the addresses set out in these terms and conditions. Entries that contain any objects not specified in these term and conditions will be deemed invalid and will not be accepted. The Promoter and its agents take no responsibility whatsoever for such entries that do not comply with these terms and conditions.
  17. Any entrant found to be using any form of software or third party application to enter multiple times (including scripting software) will have all entries invalidated and any claim to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any awarded prize to the Promoter. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.
  18. An entrant may not use a third party (including online competition entry site) to enter on their behalf, except where the entrant needs to use those services of that third party to enter due to a disability. If the preceding sentence has been breached, the entrant will have all entries invalidated, any claim to any prize will be invalidated and where such an entrant has already been awarded a prize before being found to have breached this clause, the entrant must immediately return any awarded prize to the Promoter. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.
  19. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State and Territory legislation. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
  20. The Promoter reserves the right to redraw the prize if an entrant who claims to be a prize winner is unable to satisfy these terms and conditions.

Copyright, Statutory guarantees, Waiver and liability

  1. In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s submission, image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with the Promoter publications or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
  2. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any directions given under State Regulation.
  3. The Promoter does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act (2010) (Australian Consumer Law) which cannot be excluded, restricted or modified. However, the remainder of this clause will apply to the fullest extent permitted by law and the Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.
  4. The Promoter is not responsible for any incorrect or inaccurate information, either caused by entrant or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
  5. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  6. All entries become the property of the Promoter. The Promoter collects personal information about you for the purposes of conducting this promotion. Any disclosure of such information will be made as required by law and in accordance with these terms and conditions but no further use of this information will be made without prior consent.
  7. All entries become the property of the Promoter (with the exception of any intellectual property rights comprised therein). All opt-in entries will be entered in to a database and The Promoter may use the entrant’s names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant.
  8. By opting-in, entrants confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes, the entrant should contact the Promoter on their details set out below. Any request to update, modify or delete the entrant’s details should be directed to the Promoter.

Privacy

  1. The Promoter collects information about you, including for example your name and contact details which you provide when registering or using our services as well as information from data houses, social media services, our affiliates and other entities you deal or interact with for example by using their services.
  2. We collect and use that information to provide you with our goods and services, to promote and improve our goods and services, to provide you with targeted advertising based on your online activities, for the purposes described in our Privacy Policy and for any other purposes that we describe at the time of collection.
  3. We may disclose your information to our related companies, including those located outside Australia. Any of us may contact you for those purposes (including by email and SMS) at any time. We may also disclose your information to our service and content providers, including those located outside Australia. If you do not provide us with requested information we may not be able to provide you with the goods and services you require.
  4. We may disclose your personal information to authorities if you are a prize winner or otherwise as required by law.

Business participants in OUR TOWN Burnett Today – $1,000 Business OUR TOWN Promotion 2021
GENERAL

  2. Information on the OUR TOWN Advertising Packages, how to enter the $1,000 Business OUR TOWN Promotion (“Competition”) and the prizes form part of these Terms and Conditions.
  3. Participating Businesses must be an ABN registered business to be eligible to participate.
  4. Entry into the Competition is deemed acceptance of these Terms and Conditions.
  5. Entry is open to all Advertisers (“participant”) within the South Burnett Today distribution area.
  6. Any participant can opt out of the Competition component of the OUR TOWN Advertising Package by contacting the Promoter in writing at the address shown at Clause 1.
  7. Contestants must be 18 years and over to be eligible.
  8. By purchasing an Advertising Package, the participant accepts these Terms and Conditions and the APN Newspaper Pty Ltd Advertising Terms and Conditions.
    PURCHASE A PACKAGE
  9. To purchase the Burnett Today OUR TOWN Advertising Package, participants must contact their Advertising Sales Representative, complete the details on the OUR TOWN Flyer to indicate their choice of package and submit this form to the Advertising Sales Representative for processing.
    BOOKINGS PERIOD
  10. Bookings open Friday October 1, 2021 and close Friday 8, 2021.
    ENTRY
  11. Participants who have purchased the Burnett Today 2021 Advertising Package are automatically entered free into the $1,008 Business Town Proud Promotion.
    COMPETITION PROMOTION PERIOD
  12. The competition component of the OUR TOWN Promotion commences Thursday October 14, 2021 and closes 4:00pm AEST Saturday November 13, 2021. Any booking forms not submitted within the Promotion Period will be deemed invalid.
    BILLING
  13. All participants shall have their advertising package billed to their normal business account.
  14. The 2021 OUT TOWN Advertising Packages are non-transferable and cannot be redeemed for cash.
  15. The advertising package components and inclusions cannot be exchanged, offered as prizes in a competition or part of another advertising package, promotion or passed to any third party outside the participant’s business without express permission from South Burnett Today Pty Ltd.
    ADVERTISING PERIOD
  16. Advertisements must run throughout the promotion period of Thursday October 14, 2021 and Saturday November 13, 2021.
  17. Advertisements cannot be banked and must be booked throughout the booking period.
  18. It is the responsibility of any participant to ensure the advertising purchased within the Advertising Booking Period has been utilised.
  19. Any advertising not used in the Advertising Booking Period will be forfeited and cannot be redeemed in cash, credit to another booking, nor can it be carried forward into the 2021/2022 Calendar year.
    CANCELLATION
  20. A participant in the 2021 OUR TOWN Advertising Package may cancel their advertising package by notifying their Advertising Sales Representative, however, there will be no refund on advertising already placed.
  21. Participants who cancel their advertising package at any time throughout the promotion period and whether fully or partially paid, will not be eligible to continue to participate in the $1,008 Business OUR TOWN Promotion.
  22. Cancellations received after all advertising has been exhausted by the participants will incur the full cost of participating and no refund will be forthcoming.
  23. The Promoter has the right to refuse any advertising booking.

PRIZES

  1. One (1) participating business will be selected by random draw as the overall winner of the competition. The winner will receive:
    • A $1,008 Advertising Package with The Burnett Today comprising:
    o $1,008 in print advertising; and
    o The advertising cannot be used for Real Estate sections, classifieds, features, supplements and pre-prints in any South Burnett Today Pty Ltd products.
    o Does not include page loadings;
    o Cannot be used to pay an existing advertising account.
    o Advertising will be booked at casual rates.
    o The winner must use the prize by 5:00pm March 31, 2021, or prize will expire, and no further prize awarded in its place, nor cash paid.
    • Recommended Retail Price of the prize is up to $1,008.00 (incl. of GST).
    • The total maximum retail value of the prize is $1,008.00 (incl. of GST).
    FURTHER TERMS AND CONDITIONS
  2. All package/s and the prize must be used by:
    o The participating business indicated on the Booking Form.
  3. The participant is responsible for all expenses over and above what is included in the prize, including additional advertising costs over and above the $1,008.00 advertising package specifications.
  4. Any taxes which may be payable because of any participant purchasing or winning an Advertising Pack is the sole responsibility of that participant.
  5. Individual participants should seek advice from a suitably qualified tax professional about the applicable tax information for their business.
    PRIZE DRAW
  6. One (1) winner will be drawn via random draw at the Burnett Today office, Monday November 29, 2021, at 10:00am AEST. (Businesses participating in the OUR TOWN Competition from Nanango, Yarraman, Blackbutt and Maidenwell)
  7. One (1) winner will be drawn via random draw at the South Burnett office, Monday November 29, 2021, at 10:00am AEST. (Businesses participating in the OUR TOWN Competition from Kingaroy and Kumbia)
  8. One (1) winner will be drawn via random draw at the South Burnett office, Monday November 29, 2021, at 10:00am AEST. (Businesses participating in the OUR TOWN Competition from Memerambi, Wooroolin, Tingoora, Wondai, Murgon Proston and Goomeri)
  9. Judge’s decision is final, and no correspondence will be entered in to about the competition winner or any other decisions the Promoter may make about the competition.
  10. The winner will be contacted by telephone.
    PRIZE COLLECTION
  11. The prize will only be awarded to the participating business owner who was issued with free entry and whose name is recorded for free entry purposes.
  12. The winner must collect their prize in person from the Burnett Today office (unless otherwise advised).
    ELIGIBILITY LIMITATIONS
  13. The following persons are ineligible to enter:
    a) Employees of, or contractors to, the Promoter as far as they are directly associated with this competition;
    b) Employees of, or contractors to, CROWFM as far as they are directly associated with this competition;
    c) The spouse, de facto spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), of such employees and contractors (whether they live in the same household or not);
    d) Contestants who have used or attempted to use any more than one name to qualify to win any contest run by the Promoter except in the case of a legal change of name.
  14. All Contestants acknowledge that even if the Promoter only learns of a person’s ineligibility after the Promoter has appeared to award the prize to the ineligible person, it may require the return of the prize or payment of its value to the Promoter to be dealt with as an unclaimed prize.
    PROMOTER’S LIMITATION OF LIABILITY
  15. All participants acknowledge that the Promoter has the right to publicise and publish his/her name, character and likeness.
  16. The participants in the $1,008 Business OUR TOWN Promotion agree to participate in any news media activities surrounding the promotion (e.g., interview and photo, for pages of our website and/or newspapers).
  17. All participants must avail themselves for a photo if required by the Promoter and acknowledge that the Promoter has the right to utilise publicity photos in any reasonable manner it sees fit without compensation to the participant.
  18. It is the participant’s responsibility to advise the Promoter of any change of personal details and the Promoter bears no responsibility for incorrect personal or postal address information.
  19. The Promoter is not responsible for any incorrect or inaccurate information, either caused by a participant or for any of the equipment or programming associated with or utilised in the competition, or for any technical error, or any combination thereof that may occur in the course of the administration of the competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
  20. The Promoter is not responsible for lost, late, incomprehensible, or incorrect forms lodged throughout the promotion.
  21. In the event of war, terrorism, state of emergency, disaster or (without limitation) any other event outside our reasonable control, the Promoter is entitled to cancel, terminate, modify, or suspend the advertising package and competition.
  22. If for any reason the advertising and competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond our control which corrupts or affects the administration, security, fairness, integrity or proper conduct of this advertising package, we are entitled in our sole discretion to disqualify any individual who tampers with the publishing process, and to cancel, terminate, modify or suspend the advertising package.
  23. A participant agrees to release the Promoter and their related bodies from any and/or all causes of action, losses, liability, damage, expense (including legal expenses) cost or charge suffered, sustained or in any way incurred by the participant because of any loss or damage to any physical property of the participant, or any injury to or death of any person arising out of, or related to, or in any way connected with the Promoter or the advertising packages.
  24. In the event of a Promoter other than South Burnett Today Pty Ltd cancelling any event related to this prize, South Burnett Today Pty Ltd nor its subsidiaries cannot be held responsible.
    ENTRIES AND PRIVACY
  25. All Participant’s information becomes and remains the property of the Promoter and its related parties, subject to the limits contained in the Privacy Statement and as set out in these terms and conditions.
  26. The Promoter and its related parties, also collect personal information to conduct the Promotion and may use and disclose such information in accordance with its privacy policy www.burnetttoday.com.au/privacy, including to sending ongoing information and promotional material about opportunities, services and products (relating to our business or a third-party business) in which the Promoter believes a participant may be interested.
  27. To facilitate this participation, the Promoter may disclose a participant’s personal information to other companies associated with this promotion.
